Massachusetts Construction Compliance Requirements

Mechanics Lien Law

Massachusetts mechanics liens must be filed within 90 days of last furnishing under MGL c.254. A Notice of Identification must be filed within 60 days of first providing labor or materials (for sub-subcontractors). A Notice of Contract is filed by the general contractor. Dissolution bonds can be used to remove liens.

Prevailing Wage Requirements

Massachusetts requires prevailing wages on all public works projects (no minimum threshold) under MGL c.149 s.26-27. Department of Labor Standards sets rates. Certified payroll required weekly. One of the most comprehensive state prevailing wage laws.

Insurance Requirements

Workers compensation required for all employers with 1+ employees. Minimum $1M general liability, $2M aggregate standard. Massachusetts has a competitive insurance market with strong enforcement.

OSHA & Safety Compliance

Massachusetts follows federal OSHA for private sector. State operates a plan for state and local government employees through the Department of Labor Standards. Private sector under federal OSHA.
