New Jersey Construction Compliance Requirements

Mechanics Lien Law

New Jersey Construction Lien Law (NJS 2A:44A) requires a Notice of Unpaid Balance and Right to File Lien (NUB) to be served within 90 days of last furnishing on commercial projects. Residential projects have separate rules. Lien must be filed within 90 days after the NUB deadline. Arbitration of lien claims is common.

Prevailing Wage Requirements

New Jersey requires prevailing wages on all public works projects over $2,000 under NJS 34:11-56.25 et seq. NJ Department of Labor sets rates. Certified payroll required. New Jersey has one of the most comprehensive prevailing wage laws.

Insurance Requirements

Workers compensation required for all employers with 1+ employees. Minimum $1M general liability, $2M aggregate standard. New Jersey has a competitive private insurance market with strong regulatory oversight.

OSHA & Safety Compliance

New Jersey operates a state OSHA plan (PEOSH) for public sector employees only. Private sector follows federal OSHA. Public Employees Occupational Safety and Health covers state and local government workers.
