Tennessee Construction Compliance Requirements

Mechanics Lien Law

Tennessee mechanics liens must be filed within 90 days of completion under TCA 66-11-101 et seq. A Notice of Nonpayment must be served on the owner within 90 days of when payment was due. Tennessee requires a Notice of Completion to be filed. Remote subcontractors must provide a preliminary notice.

Prevailing Wage Requirements

Tennessee does not have a state prevailing wage law (repealed in 2015). Federal Davis-Bacon applies to federally funded projects only. No state certified payroll requirements.

Insurance Requirements

Workers compensation required for employers with 5+ employees (1+ in construction and mining). Minimum $1M general liability typical. Tennessee Department of Labor administers workers comp.

OSHA & Safety Compliance

Tennessee operates a state OSHA plan through TOSHA (Tennessee Occupational Safety and Health Administration). Covers both public and private sector. Standards generally mirror federal OSHA.
