Mechanics Lien Law

Texas requires retainage notices and fund trapping notices for subcontractors to preserve lien rights. Mechanics liens must be filed by the 15th day of the 4th month after the month work was last performed. Monthly statutory notices may be required.

Prevailing Wage Requirements

Texas does not have a state prevailing wage law. Federal Davis-Bacon Act applies to federally funded projects. Certified payroll requirements follow federal standards on applicable projects.

Insurance Requirements

Workers compensation is not required in Texas but strongly recommended. Minimum $500K-$1M general liability typical for commercial projects. Additional insured and waiver of subrogation endorsements standard on GC contracts.

OSHA & Safety Compliance

Texas follows federal OSHA standards. No state OSHA plan. Texas Workforce Commission handles workers compensation disputes. State specific heat illness guidelines issued by OSHA Region 6.
